Introduction to the Terms of Use Agreement:

Our online store, Wiki Beauty Store, welcomes you and informs you that you will find below the terms and conditions that govern your use of this store and all legal effects arising from your use of the store’s services via the internet through this electronic platform. Any person’s use of the store, whether as a consumer of a service or a product of the store, or otherwise, constitutes acceptance and approval on their part—while having full legal capacity according to Sharia and the applicable laws and regulations—of all the provisions and clauses of this agreement, and is a confirmation of their commitment to its systems and what is stated therein. This agreement applies to all types of dealings between the consumer and the store. This agreement is deemed effective and enforceable as soon as you approve it and begin registering on the store, in accordance with Article 10 of the Saudi Electronic Transactions Law.

Article One – Preamble and Definitions:

The above preamble is considered an integral part of this agreement. Below you will find the meanings and definitions of the main terms used in this agreement:

“Wiki Beauty Store”: This definition includes all forms of the store on the internet, whether an electronic application, a website on the internet, or a physical retail store.
“Consumer”: The person who engages in e-commerce in order to obtain products or services provided by the store through its electronic platform.
“Agreement”: This term refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.

Article Two – Consumer’s Legal Capacity:

The consumer acknowledges that they have full legal capacity according to Sharia and the law to deal with Wiki Beauty Store and that they are at least eighteen (18) years old.
The consumer agrees that in the event of violating this article, they shall bear the consequences of such violation towards third parties.

Article Three – Nature of the Store’s Obligation:

The store’s obligation towards consumers is to provide the (service or product).
The store may provide other services, such as after-sales services or other related services, depending on the nature and type of the (service or product) requested by the consumer.

Article Four – Rules of Use:

The consumer undertakes to use the store’s electronic platform in a manner consistent with public morals and the regulations in force in the Kingdom of Saudi Arabia.
The consumer undertakes, when purchasing any service or product from this store, not to use such service or product in any way that violates public morals or the regulations in force in the Kingdom of Saudi Arabia.

Article Five – Accounts and Registration Obligations:

Once you apply to join Wiki Beauty Store as a user, you are required to disclose specific information and choose a username and password to be used when accessing the store’s services. By doing so, you agree to:

Be responsible for maintaining the confidentiality of your account information and password, and agree to notify Wiki Beauty Store of any unauthorized use of your account information on the store or any other breach of your confidential information.
The store shall in no case be liable for any loss that you may incur, directly or indirectly, whether moral or material, as a result of the disclosure of your username or login information.
You undertake to use your account or membership on the store by yourself and are fully responsible for it; and in the event that someone else uses it, this shall be considered evidence that you have authorized them to use the store in your name and on your behalf.
You undertake to use the store with seriousness and honesty.
You undertake to disclose true, correct, updated, complete, and lawful information about yourself as required during registration on Wiki Beauty Store, and you undertake to update your data whenever it changes in reality or whenever needed.
Our store undertakes to treat your personal information and contact details with strict confidentiality.
If it becomes apparent to the store that you have disclosed information that is untrue, incorrect, not current, incomplete, unlawful, or in violation of this Agreement, Wiki Beauty Store has the right to suspend, freeze, or cancel your membership, store, or account on the platform, without prejudice to the store’s other rights and its legitimate means to recover its rights and protect other consumers.
In case of non-compliance with any of the above, the store’s management has the right to suspend or cancel your store or membership or block your access to the store’s services again.

Article Six – Electronic Communications and Official Channels:

The parties to this agreement agree that communication shall be conducted via the e-mail or WhatsApp number registered on the platform.
The consumer agrees that all agreements, announcements, statements, and other communications provided electronically shall be deemed equivalent to their written counterparts and shall constitute valid evidence in meeting legal and Sharia requirements.
The consumer agrees that they may be contacted and notified of any provisions relating to this agreement or to their dealings through the store by the store’s management sending general messages to all consumers or specific users of the store.

Article Seven – Amendments to the Terms of Use and Fees:

If any clause or provision in this agreement is cancelled or ceases to be effective, such matter shall not affect the validity of the remaining clauses, provisions, rules, and terms set out in this agreement, and they shall remain in force until further notice from the management of Wiki Beauty Store.
This agreement—which may be amended from time to time as required—constitutes the operational and understanding mechanism and the agreement between the (consumer) and the (store).
The store may impose fees on some consumers, depending on the offers, products, or services they request, or on any fees or taxes imposed by the state on the nature of the product or service.
The store reserves the right to add, increase, reduce, or deduct any fees or expenses, pursuant to the provisions and terms of this Terms of Use Agreement, on any consumer, regardless of the reason for their registration.

Article Eight – Payment and Settlement Services in Wiki Beauty Store:

The store undertakes to provide commonly recognized accounting standards in its online store, in implementation of this agreement and in view of the legal, economic, commercial, and regulatory interests inherent in this system.
The store undertakes to set the price of the service or product offered in its store in accordance with the commonly recognized market value.
The store undertakes to provide invoices, receipts, and acknowledgment documents for all amounts and profits generated in its store, and undertakes to provide the consumer with an invoice for their purchase of any service or product.

Article Nine – Intellectual Property:

All intellectual property rights pertaining to the store are fully owned by the store, whether such rights were owned prior to the establishment of this electronic platform or acquired thereafter.
The consumer shall respect the intellectual property rights of the store, including the store’s name, as well as any words, logos, or other symbols belonging to or displayed on the store. Any right associated with the store’s name is fully owned by the store as intellectual property.

Article Ten – Store Liability:

The store undertakes to conduct its commercial activity through this electronic platform lawfully and in accordance with the regulations in force in the Kingdom of Saudi Arabia and the provisions of this agreement.
The store shall not bear any claims arising from errors or negligence, whether resulting directly, indirectly, incidentally, by the consumer, or by a third party such as shipping companies.
Wiki Beauty Store, its employees, owners, and representatives undertake that the (product or service) shall be sound, lawful, and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia, and that it shall be used for lawful purposes.

Article Eleven – Restriction of Access or Membership:

The store may suspend or cancel the consumer’s membership or restrict their access to the platform’s services at any time, without notice and for any reason, without limitation.

Article Twelve – Governing Law:

This Terms of Use Agreement is governed and drafted in accordance with the laws, regulations, and legislations in force and applicable in the Kingdom of Saudi Arabia, and is fully and entirely subject to the regulations applicable by the authorities in the Kingdom of Saudi Arabia.

Article Thirteen – General Provisions:

If any clause or provision in this Terms of Use Agreement is cancelled or ceases to be effective, such matter shall not affect the validity of the remaining clauses, provisions, and terms set out in this Terms of Use Agreement, and they shall remain in force until further notice from the store’s management.

This Terms of Use Agreement—which may be amended from time to time as required—constitutes the usage agreement, operational mechanism, understanding, agreement, and contract between the store and the consumer. Both parties to this agreement also agree to the following:

The Arabic language is the language to be applied when interpreting the provisions of this agreement or when translating it into any other language.
All prices displayed for the store’s services or products may be modified from time to time.
Any promotional or marketing offers provided by the store are temporary offers; the store has the right to amend or terminate such promotional or marketing offers at any time.
The parties to this agreement undertake to deal with each other in a manner that does not violate the Sharia rules and the laws and regulations in force that are related to the nature of the relationship between the store and the consumer.
This Terms of Use Agreement may not be cancelled except by a decision issued by the store’s management.
